Sounds like these lawmakers haven't been around the block with SOPA and other state legislation to control what happens on the Internet. The critical phrase is "New York-based website". Is that a registered New York company? A server in a garage located in New York? I've got websites whose Apache, IE, or JBoss instance is loaded on a server in England thats owned by a New York company. Does that count? Let's see.
